Investment Highlights
WAMUQ recently announced that it has filed with the U.S. Bankruptcy Court for the District of Delaware an amended plan of reorganization and disclosure statement. As reported, the plan implements and incorporates the terms of a revised global settlement agreement reached among the Company, the Federal Deposit Insurance Corp. (FDIC) and JPMorgan Chase Bank N.A.
“WMI has worked diligently over the last 20 months to maximize the value of the bankruptcy estate and is confident that the Amended Plan will accomplish the objective of providing substantial recoveries for WMI’s creditors,” the Company said in a statement.
The FDIC seized WAMUQ’s flagship bank in 2008 and sold its assets to JPMorgan for $1.9 billion. The sale resulted in the two banking companies and the parties filing lawsuits against one another over roughly $4 billion in disputed deposit accounts. A settlement agreement between the WAMUQ, the FDIC and JPMorgan will serve as the basis for the troubled company’s reorganization plan.
The Company previously reported that the Bankruptcy Court held a hearing on June 3 to consider the approval of the disclosure statement, and it will ask the Bankruptcy Court to confirm its plan by July 20, following the said approval.
As it was working its way to emerging from bankruptcy, WAMUQ’s move suffered a setback when bankruptcy judge Mary Walrath postponed the consideration of the outline of its reorganization plan and told the Company’s attorneys to talk further with shareholders about their requests for documents. As reported by Reuters, WAMUQ shareholders are seeking information underlying the proposed settlement, in which JPMorgan agreed to turn over the disputed deposits to the Company. The disclosure statement hearing was reportedly postponed to June 17.
